Florida Judge Dismisses DeSantis’ Challenge to School Mask Mandates

In a significant legal setback for Florida Governor Ron DeSantis, a state judge has rejected his appeal regarding school mask mandates, further complicating his efforts to prevent such requirements in educational settings. As the Delta variant of COVID-19 continues to spread, many officials remain hesitant to impose mask mandates in vulnerable areas, including schools and daycare facilities. DeSantis has been particularly outspoken against these measures, even threatening to cut funding for school districts that enforce mask-wearing for students, staff, and visitors.

However, Second Circuit Judge John Cooper ruled that Florida schools possess the authority to implement mask mandates, effectively dismissing DeSantis’ appeal. This decision enables school districts to enforce mask policies without fear of repercussions from the governor’s office—at least until the appeal is reviewed by a higher court. DeSantis had previously contested a ruling that deemed his executive order banning mask mandates as lacking legal foundation, according to Axios.

Supporters of the ruling, like Twitter user BrooklynDad Defiant!, expressed their approval online, stating, “Take that, DeSantis!” Nevertheless, this legal battle is not over; the appeal will advance to the First District Court of Appeal, where arguments from all parties will be thoroughly examined. Judge Cooper noted, “It’s undisputed that the Delta variant is far more infectious than previous strains, particularly affecting children under 12 who cannot be vaccinated. There are limited options to protect them—either they stay home or wear masks.”

This week has been particularly challenging for DeSantis. Notably, Dr. Anthony Fauci publicly challenged the governor’s previous statements suggesting that vaccination is solely a personal choice. Fauci countered that during an infectious disease outbreak, individual choices impact the broader community. He emphasized the collective responsibility that leaders should uphold in a pandemic.
