A Federal Appeals Court has temporarily halted the enforcement of New York City’s vaccine mandate for teachers and school staff just as it was set to begin. This comes after a tumultuous start to the school year. Approximately a month prior, Mayor Adams announced that all educators and personnel within the city’s vast school district were required to receive at least their first vaccine dose by September 27.

However, just days before the mandate’s implementation, a federal appeals judge placed a temporary injunction against the New York City school system. The case, initiated by four educators, has been expedited to a three-judge panel, which is expected to review it on September 29.

“We are optimistic that once all the evidence is presented, the vaccine mandate will be upheld, providing the necessary protection for our students and staff,” stated spokesperson Taylor Madison from the New York City Department of Education. While the mandate is not currently in effect, those who are unvaccinated are required to undergo weekly COVID testing and submit their results to the district.

Despite the potential for the mandate to be reinstated soon, the two-day delay poses a risk for the spread of the highly contagious Delta variant in the nation’s largest school district. Unlike many other districts, New York City public schools are not offering any remote learning options this year. Currently, around 82% of teachers and staff have been vaccinated. The United Teachers Union reports that approximately 6,000 members remain unvaccinated, with half of those seeking medical exemptions.

Parents are expressing a variety of feelings regarding the implications for their children’s safety, with many feeling confused and frustrated about the handling of the situation. The recurring question remains: why are some adults refusing to get vaccinated? If the mandate is approved on Wednesday, how fast will staff need to comply? Schools Chancellor Lisa Tran has already informed Department of Education staff to prepare for the possibility of the mandate being enforced later in the week.

In the meantime, remember to wear masks in public spaces, get vaccinated if you’re eligible, and discuss the importance of vaccination with loved ones who may be hesitant.
