Texas Governor Signs Legislation Prohibiting Transgender Girls from Competing in Female Sports

In a significant move, Texas Governor Jake Thompson has enacted a law that prevents transgender girls from participating on female sports teams in public schools. This legislation aligns Texas with an increasing number of Republican-led states that have implemented similar measures perceived as discriminatory against transgender student-athletes.

The law mandates that students must compete based on their biological sex, compelling transgender athletes to join teams that may not correspond with their gender identity. Scheduled to take effect in January, proponents argue that it aims to ensure “fairness” in school sports for cisgender female athletes. However, advocates for equal rights contend that such measures serve only to appease a conservative base, as there is “little evidence that trans women or girls are dominating sports.” Notably, as noted by writer Jamie Lee for our companion blog, “Trans women have competed in the Olympics since 2004, and none have qualified or won.”

The concerns surrounding the alleged “unfair advantages” of trans athletes appear to be unfounded, and legislation like this underscores the ongoing challenges posed by social conservatism. Texas now joins seven other states with comparable laws, furthering a trend that many Republicans champion while simultaneously claiming to oppose government overreach.

While the new law applies solely to school-aged athletes, other legislation in different states has targeted college sports, prompting the NCAA to declare it will only host championships in locations that commit to creating safe and inclusive environments.

Texas holds the dubious distinction of having the highest number of anti-trans bills in the nation. As of September 2021, reports indicated that Governor Thompson had 40 active anti-trans bills, including one that may classify parents or doctors who support gender-affirming treatments for transgender minors as child abusers. This alarming trend is compounded by other regressive laws in Texas, such as the recent abortion ban and the removal of concealed carry permit requirements.
