On May 16, President Joe Biden enacted the Safe Sleep for Babies Act (H.R. 3182), which prohibits the manufacturing, sale, or distribution of crib bumpers and inclined sleepers for infants, devices associated with over 200 infant fatalities. Senators Tammy Duckworth, Rob Portman, and Richard Blumenthal were instrumental in introducing this legislation.

The bill swiftly progressed through Congress, having been passed by the Senate on May 3. The House approved it the previous year, and just days after reaching his desk, Biden signed it into law. This legislation specifically defines crib bumpers as any materials intended to line the inside of a crib, aimed at preventing impacts against crib sides or access to gaps, but exempts mesh liners from the ban.

In April 2019, Consumer Reports highlighted the dangers of the Fisher-Price Rock ‘n Play Sleeper, linking it to at least 32 infant deaths. Despite a recall, it was revealed that Mattel, the parent company of Fisher-Price, was aware of safety concerns regarding the product, which had generated over $200 million in revenue since its launch in 2009. Advocacy from families affected by these hazardous items played a crucial role in pushing for this bill. “Three years of hard work and tears finally paid off in justice for our angels,” said Mary Johnson, whose child tragically passed away in a Rock ‘n Play Sleeper.

The American Academy of Pediatrics (AAP) has consistently warned against the use of inclined sleepers and crib bumpers due to their increased risk of suffocation. “The safest sleep environment for babies is a firm, flat, bare surface,” stated AAP President Moira Szilagyi, emphasizing the misleading nature of these products on the market.

Portman remarked, “The use of crib bumpers pose an unnecessary threat to the health and safety of infants everywhere. Congress must act to protect infants from any unnecessary risk.” Parents who are uncertain about the safety of their infant’s sleep products are encouraged to consult their pediatricians for advice.
